UAE Free Zone Labour Law Employee Rights 2026
UAE federal labour law (Federal Decree-Law No. 33 of 2021) applies to employees of most UAE free zone companies. DIFC and ADGM operate their own employment laws. This guide covers key employee rights, employer obligations, and recent 2021 reforms affecting UAE free zone employees in 2026.
Key UAE Labour Law 2021 Reforms
- Fixed-term contracts mandatory: all employment contracts must be fixed-term (maximum 3 years, renewable)
- Probation: maximum 6 months, termination during probation requires 14 days’ notice (employer) or 1 month (employee seeking new UAE job)
- Annual leave: minimum 30 calendar days per year (after 1 year of service)
- Sick leave: 15 days with full pay, 30 days with half pay, 30 days unpaid (per year after 3 months service)
- End-of-service gratuity: 21 days’ basic salary per year (first 5 years), 30 days per year thereafter
Working Hours and Overtime
- Standard hours: 8 hours/day, 48 hours/week
- Ramadan: reduced to 6 hours/day for Muslim employees
- Overtime rate: 25% above normal wage (50% for night overtime and Friday overtime)
- Maximum: employee cannot work more than 12 hours in one day including overtime
Termination Rights 2026
- Notice period: minimum 30 days (first year), typically 30–90 days as per contract
- Arbitrary dismissal compensation: 3 months’ full wage (if employer arbitrarily terminates)
- End-of-service gratuity: paid on termination/resignation (after 1 year service) based on final basic salary
- Final settlement: must be paid within 14 days of termination
DIFC and ADGM Employment Laws
DIFC Employment Law (Law No. 2 of 2019 as amended) governs employment in DIFC. ADGM Employment Regulations (2019) govern ADGM. Both are more closely aligned with international (common law) employment standards than UAE federal labour law. Key differences: DIFC/ADGM contracts can be for indefinite term (not mandatory fixed-term), end-of-service gratuity structure differs, and broader anti-discrimination provisions apply.
Wage Protection System (WPS)
UAE Wage Protection System (WPS) requires employers to pay salaries via electronic bank transfer through MOHRE-registered banks. All UAE free zone employees (outside DIFC/ADGM) must be paid via WPS. Non-compliance results in work permit bans and fines. WPS data is monitored by MOHRE to detect salary delays.
