UAE Probation Period: Maximum Duration
Under Federal Decree-Law No. 33 of 2021: Maximum probation period: 6 months from the start of employment. This cannot be extended beyond 6 months, even if both employer and employee agree. During probation: either party may terminate the employment contract with reduced notice. An employee cannot be subjected to a second probation period in the same company after successful completion of the first.
Termination During Probation
Employer terminating during probation: minimum 14 days written notice required (or payment in lieu). The employer does NOT need a reason to terminate during probation. Probation is specifically designed to give employers this flexibility. No gratuity entitlement: employees terminated during probation are not entitled to end-of-service gratuity. You must complete 1 full year for gratuity to apply. Employee terminating during probation to take another UAE job: must give 1 month notice AND, if the employee joins another UAE employer within 3 months, the new employer may be required to reimburse the previous employer’s recruitment and visa costs (Article 10, Federal Decree-Law 33/2021). Employee terminating to leave the UAE: 14 days notice required. No reimbursement obligation.
Benefits and Leave During Probation
During probation period: annual leave accrues from day 1 but may not be taken (taking leave during probation requires mutual agreement). Sick leave: UAE Labour Law grants sick leave rights from the first day of employment. There is no probation exclusion. End of probation: successful completion triggers full employment rights (annual leave entitlement accessible, gratuity starts accruing).
